Attendance and Cancellation Policy 

Acknowledgment of Risk:  I, the undersigned, hereby acknowledge that I am voluntarily participating in the event organized by Your Premier Vacation LLC dba Your Premier Vacation (“Your Premier Vacation”), which includes being transported to and from the event location(s) (the “Covered Activities”). I understand that participation in the event and the transportation may involve risks, including but not limited to:

–          Motor vehicle accidents
–          Injuries caused by sudden stops or turns
–          Boarding and exiting the vehicle(s)
–          Exposure to weather or environmental conditions

Assumption of Risk: The term Covered Activities shall apply to any and all activities of any nature whatsoever that occur during the event and transportation, regardless of the location and use of the facilities, vehicle, and equipment. I understand, acknowledge, and agree that the Covered Activities will expose me to a risk of personal injury, property damage, and/or death. The success of any Covered Activities is dependent upon a number of factors, some controllable and others outside of the control of Your Premier Vacation. Issues that may arise include, but are not limited to equipment malfunction, improper or negligent driving, and third-party error. Because the Covered Activities are subject to equipment malfunction, environmental factors, third-parties, and operator error, I cannot rely on them functioning perfectly. Despite these possibly deadly risks, I agree that I am assuming all of the inherent risks in the Covered Activities.  I recognize and acknowledge that Your Premier Vacation is not a common carrier nor is it in the business of providing transportation services to the public. I explicitly understand that there are risks that are not foreseeable or avoidable and, even if the individuals and the equipment perform perfectly, I can still be injured or killed. I voluntarily assume full responsibility for any risk of loss, personal injury, property damage, or other risks, whether foreseen or unforeseen, that may arise from my participation in this event and any guests that I may invite including the use of provided transportation. I acknowledge that the event organizers have taken reasonable precautions for safety but cannot eliminate all risks associated with transportation.

Third-Party Providers: I understand that Your Premier Vacation may utilize the services of third-parties during the Covered Activities (“Third-Party Services”).  I shall indemnify, defend, and hold harmless the Released Parties from and against any and all claims or losses incurred by any of them and shall defend the Released Parties against all claims arising from or in connection with this Agreement, the actions of any Third-Party Providers, or in relation to any Third-Party Services. 

Waiver of Liability: In consideration of being allowed to participate in this event, including the transportation. I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, and any guests that I invite hereby release, waive, discharge, and hold harmless Your Premier Vacation LLC dba Your Premier Vacation and any affiliated organizations, event sponsors, and their respective officers, employees, agents, and volunteers (the “Released Parties”) from any and all claims, demands, actions, or causes of action, whether arising out of negligence or otherwise, that I may have or claim to have against them arising out of or relating to my participation in the event and use of transportation provided for myself and any guests that I invite to participate.

Covenant not to Sue: You (as well as my heirs, executors, administrators, guardians, legal representatives, and assigns) hereby agree to never file or bring any suit, claim, or complaint against the Released Parties for damages or causes of action related to my participation in the Covered Activities, even if they are, wholly or partially, the result of the negligence of any of the Released Parties. Should any such suit or action at law or otherwise be instituted in violation of this Waiver by me, my heirs, distributees, executors, administrators, guardians, legal representatives, assigns, or anyone else claiming on my behalf, I agree that the Released Parties, as well as anyone else named as a party in such suit or action in violation of this Waiver, shall be entitled to recover attorney’s fees and costs incurred in defense of such suit or action, including any appeals therefrom.

Indemnification: To the fullest extent allowed by law, I (as well as my heirs, executors, administrators, guardians, legal representatives, and assigns) agree to indemnify, defend, and hold all Release Parties harmless, from and against any and all losses, damages, liabilities, claims, demands, actions, judgments, costs, and legal or other expenses (including, without limitation, reasonable attorneys’ fees, costs, expert costs, and expenses) incurred as a result of the Covered Activities. I have been advised and recognize that the Covered Activities are NOT COVERED by any personal accident or general liability insurance policy issued to the Released Parties. This Section shall apply to activities caused by the negligence and/or other fault, either active or passive, of any Released Parties, or from any other cause.

Consent to Medical Treatment: In the event of an emergency, I consent to any necessary first aid or medical treatment provided during my participation in the event and transport. I understand that I am responsible for any medical costs incurred as a result of such treatment for myself or any guests that I invite to participate.

Validity of Waiver. I (as well as my heirs, executors, administrators, guardians, legal representatives, and assigns) understand and agree that if I institute, or anyone on my behalf institutes, any suit or action at law or any claim for damages or cause of action against any of the Released Parties because of an injury to my person or property, or death, due to the Covered Activities, this Waiver can and will be used as evidence in court, and that Waivers like this have been upheld in courts in similar circumstances.

Miscellaneous: I affirm that I am physically capable of participating in this event. I also understand that I or any guests that I invite to participate may be removed from the event or transportation at the discretion of the organizers if I/we do not adhere to the event’s safety rules or policies. I understand that Your Premier Vacation values inclusion and access for all participants and are pleased to provide reasonable accommodations for the Covered Activities. I agree to contact Your Premier Vacation at events@yourpremiervacation.com to make a reasonable accommodation request. Requests must be submitted within 30 days of any Covered Activities. I shall also include any information regarding any physical or mental limitations, allergies, and other relevant information for my safety.

Photographic and Video Release: I grant Your Premier Vacation the right to take photographs and videos of me and any guests that I invite to participate during the event and to use such media for promotional purposes without any compensation to me.

Successors and Assigns. This Waiver shall inure to the benefit of and be binding upon the successors and permitted assigns of each of the Parties. 

Agreement: I have carefully read and fully understand the contents of this Waiver of Liability, Assumption of Risk, and Indemnity Agreement for myself and any guests that I invite to participate. I voluntarily sign it and understand that it is a binding legal document that waives certain rights.
